Dec 17, 2020 – Mohammed v Dexterra Integrated Facilities Management

The BC Supreme Court awarded 5 months of pay in lieu of notice to the wrongfully dismissed plaintiff in Mohammed v Dexterra Integrated Facilities Management, 2020 BCSC 2008. Relevant factors included:

  • Job: Supervisor of cleaning staff
  • Notice period: 5 months

The plaintiff’s duties were described by the Court as follows:

Dexterra says that even though Mr. Mohammed was a supervisor, his position was non-managerial; he lacked the authority to hire, fire, discipline, and to be involved with payroll. In that respect, I agree…Mr. Mohammed was responsible to ensure the crew of six to eight workers in his unit properly carried out their tasks. His role was particularly important to Dexterra given its maintenance staff’s performance issues at Tsawwassen Mills Mall.
