The BC Supreme Court awarded 18 months of pay in lieu of notice to the wrongfully dismissed plaintiff in McLeod v Lifelabs BC LP, 2015 BCSC 1857. Relevant factors included:

  • Plaintiff’s age: 49 (approx)
  • Length of service: 25.5 years
  • Job: Process improvement manager
  • Notice period: 18 months

The plaintiff’s duties were described by the Court as follows:

She provided a support function for other managers. She was senior to them in her experience with the defendant although the senior designation was removed from her title with this position. The plaintiff had no one reporting to her directly as she did formerly.
