The BC Supreme Court awarded 19 months of pay in lieu of notice to the wrongfully dismissed plaintiff in Frith v. IBM Canada Limited/IBM Canada Limitee, 2018 BCSC 122. Relevant factors included:

  • Notice period: 19 months

The plaintiff’s duties were described by the Court as follows:

The BC Government Health Services Sector was a large client account for IBM. Mr. Frith served as the primary day‑to‑day contact for IBM with that client.
